These Terms and Conditions ("Terms") govern your access to and use of the website located at eresuccess.com (the "Site") operated by Experience Real Estate Group, LLC ("EREG," "we," "us," or "our"), a licensed Florida real estate brokerage.
By accessing or using the Site, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, please do not access or use the Site.
These Terms should be read together with our Privacy Policy, which is incorporated by reference.

Your access to and use of the Site constitutes your agreement to these Terms and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Site, including prospective buyers, prospective sellers, licensed real estate professionals, and anyone interested in Southwest Florida real estate.
EREG reserves the right to update these Terms at any time. We will notify users of material changes by updating the "Last Updated" date above and, where appropriate, posting a notice on the Site. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

These services are provided for informational and promotional purposes. Use of the home search and home valuation features requires creation of a free RealScout account. All services are provided subject to these Terms and the terms of any applicable third-party providers.
Nothing on this Site constitutes a binding offer, representation, or warranty regarding any specific property, market value, or transaction outcome. All real estate information is subject to change without notice.

Real estate listing data displayed on this Site is provided through Internet Data Exchange (IDX) agreements with the following Multiple Listing Services:
IDX data is provided exclusively for consumers' personal, non-commercial use. You may use IDX data only to identify prospective properties you may be interested in purchasing. The following uses are expressly prohibited:

This Site integrates RealScout, a third-party real estate technology platform, to provide home search, home valuation, and market alert services. When you create a RealScout account through this Site or through an EREG Entrepreneur's profile page, you enter into a separate agreement with RealScout, Inc. and are subject to RealScout's Terms of Service and Privacy Policy in addition to these Terms.
Home valuation estimates provided through RealScout's Home Value Alert system are automated estimates based on available MLS data and algorithmic analysis. They are not appraisals, broker price opinions (BPOs), or professional valuations. They should not be relied upon as the sole basis for any financial or real estate decision. A licensed Florida real estate professional should be consulted for any property-specific pricing guidance.
Market activity alerts and listing alerts are automated notifications generated by RealScout. EREG and its Entrepreneurs are not responsible for delays, inaccuracies, or omissions in alert delivery caused by RealScout's systems or MLS data feeds.
EREG is not responsible for the availability, accuracy, or functionality of RealScout's platform. Any claims relating to RealScout's services should be directed to RealScout, Inc. directly.

You agree to use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

Certain features of this Site — including home search, home valuation, and market alerts — require creation of a free RealScout account. When you create an account, you agree to:
EREG reserves the right to suspend or terminate any account that we believe, in our sole discretion, violates these Terms, RealScout's Terms of Service, or applicable law.
RealScout accounts are subject to RealScout's Terms of Service and Privacy Policy. EREG is not responsible for the security or administration of RealScout accounts beyond its own obligations as a RealScout Pro+ participant.

The Site and all of its content — including but not limited to the EREG name, logo, tagline "The Experience Starts With You.™", page designs, typography, photography, text, and blog articles — are the property of Experience Real Estate Group, LLC or its content suppliers and are protected by United States copyright, trademark, and other intellectual property laws.
The trademark "The Experience Starts With You.™" is claimed by Experience Real Estate Group, LLC. Unauthorized use of this mark is prohibited.
You may access and use the Site for personal, non-commercial purposes only. You may not:
Limited permission is granted to individual visitors to display, download, and print pages from this Site for personal, non-commercial use only, provided that all copyright and proprietary notices are maintained. This permission does not extend to MLS listing data, which is governed by separate MLS rules as described in Section 3.

Each EREG Entrepreneur maintains a personal profile page on this Site. Entrepreneurs are granted limited access to edit their own pages — including their biography, photo, contact details, and blog content — and are solely responsible for the accuracy and lawfulness of the content they publish on their individual pages.
Content published by individual Entrepreneurs on their profile pages, blog posts, and sub-pages does not necessarily represent the views or positions of EREG as a company. EREG reserves the right to review, remove, or modify any Entrepreneur-published content that violates these Terms, applicable law, the NAR Code of Ethics, or EREG's internal standards.
RealScout widgets embedded on individual Entrepreneur pages — including home search, home valuation, and listing display — are linked to the individual Entrepreneur's RealScout agent account. Leads and contacts generated through an Entrepreneur's page are directed to that Entrepreneur directly.
Entrepreneurs are independent real estate licensees, not employees of EREG. Each Entrepreneur operates their own real estate business within the EREG brokerage network and is individually licensed by the Florida Department of Business and Professional Regulation (DBPR).

Your use of this Site does not create a brokerage or agency relationship between you and EREG or between you and any EREG Entrepreneur. No brokerage relationship is created unless and until a written brokerage agreement is executed between you and an EREG Entrepreneur in accordance with Florida law.
Under Florida law (Section 475.278, Florida Statutes), real estate licensees are required to disclose their relationship with buyers and sellers. EREG Entrepreneurs operate as Transaction Brokers unless a Single Agent relationship is established by written agreement. Florida law requires that licensees operating as Single Agents provide buyers and sellers with specific statutory disclosure of their duties.
Nothing on this Site constitutes the rendering of real estate, legal, financial, tax, or other professional advice. You should consult with a licensed professional before making any real estate, financial, or legal decision.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EREG, ITS OFFICERS, DIRECTORS, ENTREPRENEURS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of or inability to use the Site or its services, including but not limited to:
In no event shall EREG's total liability to you for all claims arising from or relating to use of the Site exceed the amount you paid to EREG, if any, in the twelve months preceding the claim, or one hundred dollars ($100.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Experience Real Estate Group, LLC is a licensed Florida real estate brokerage operating under the Florida Real Estate Commission (FREC) and the Florida Department of Business and Professional Regulation (DBPR). All EREG Entrepreneurs hold individual Florida real estate sales associate or broker associate licenses issued by DBPR.
As required by Florida Statute Section 475.25(1)(r), our brokerage and qualifying broker license information is provided below:
EREG's Entrepreneurs are affiliated independent contractors, not employees of EREG. Each Entrepreneur is individually responsible for their real estate activities and client relationships in accordance with their individual licensure and EREG's brokerage policies.
Florida law requires that real estate transaction records be maintained for a minimum of five (5) years from the date of the transaction or from the date the transaction was terminated, in accordance with Florida Administrative Code Rule 61J2-14.012.

You agree to defend, indemnify, and hold harmless EREG, its officers, directors, Entrepreneurs, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. The Florida Real Estate Commission rules (Florida Administrative Code Chapter 61J2) and the Florida Real Estate License Law (Chapter 475, Florida Statutes) govern the real estate brokerage activities described herein.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Lee County, Florida. You hereby consent to the personal jurisdiction and venue of such courts.

In the event of any dispute, claim, or controversy arising out of or relating to your use of this Site or these Terms, we encourage you to first contact EREG directly to attempt to resolve the matter informally. Most concerns can be resolved promptly through direct communication with our team.
If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in Lee County, Florida, administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction.
Class action waiver: You agree that any arbitration or court proceeding shall be conducted on an individual basis and not in any class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Disputes arising from real estate transactions between clients and EREG Entrepreneurs that involve the MLS may be subject to the dispute resolution procedures of the applicable MLS and the National Association of REALTORS® Code of Ethics arbitration process.

EREG reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we may provide additional notice through a banner on the Site homepage.
Your continued use of the Site after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of the Site. Previous versions of these Terms are available upon written request to EREG.
EREG will review these Terms at least annually and will update them whenever: (a) the services provided through the Site change materially; (b) applicable laws or MLS rules change in ways that affect these Terms; or (c) third-party service integrations are added, modified, or removed.
