This Privacy Policy describes how Experience Real Estate Group, LLC ("EREG," "we," "us," or "our") collects, uses, shares, and protects your personal information when you visit our website at eresuccess.com (the "Site"), use our services, or interact with our Entrepreneurs.

By using the Site, you agree to the collection and use of information in accordance with this policy. If you do not agree with any part of this policy, please do not use our Site.

Who We Are

Experience Real Estate Group, LLC is a licensed Florida real estate brokerage operating two office locations in Southwest Florida. We are the data controller responsible for your personal information collected through this Site.

We collect personal information that you provide directly to us, information collected automatically when you use our Site, and information received from third-party service providers.

We do not collect sensitive personal information such as Social Security numbers, financial account numbers, driver's license numbers, or payment card numbers through this website.

How We Collect Information

We collect information through the following methods:

Directly from you — when you create a RealScout account, use the home search or home valuation tools, complete the Entrepreneur Discovery Questionnaire via Google Forms, or contact an Entrepreneur through the site's contact modal.

Automatically — when you visit our Site, we automatically collect certain technical data including your IP address, browser type and version, pages visited, time and date of your visit, and referring URLs. This is collected through server logs, WordPress cookies, and analytics tools.

Through third-party services — RealScout collects and processes property search and home valuation data on our behalf. Google reCAPTCHA collects behavioral data to verify human users. Google Forms collects Discovery Questionnaire responses. Each service operates under its own privacy policy as described in Section 6.

From your real estate transactions — if you buy or sell property through an EREG Entrepreneur, we collect information necessary to complete and document the transaction as required by Florida real estate law.

How We Use Your Information

We use your personal information only for the purposes for which it was collected or for closely related purposes you would reasonably expect. Specifically:

We do not use your personal information for automated decision-making that produces legal or significant effects without human review. We do not sell your personal information to third parties for monetary consideration.

How We Share Your Information

We do not sell your personal information. We share your information only in the following limited circumstances:

With our Entrepreneurs — when you use the home search, home valuation, or contact features, your information is shared with the EREG Entrepreneur associated with your inquiry or account. Each Entrepreneur is bound by EREG's data handling standards and Florida real estate licensing requirements.

With service providers — we share information with third-party service providers who assist us in operating the Site and delivering services. These providers are contractually prohibited from using your information for any purpose other than providing services to us. See Section 6 for a full list.

For legal compliance — we may disclose your information where required by law, court order, or governmental authority, or where necessary to protect the rights, property, or safety of EREG, our Entrepreneurs, or others.

In a business transfer — if EREG is involved in a merger, acquisition, or sale of assets, your personal information may be transferred as part of that transaction. We will notify you via email or a prominent notice on the Site if such a transfer occurs.

We never sell, rent, or share your personal information with third-party advertisers, marketing companies, or data brokers.

Third-Party Services

Our Site integrates the following third-party services, each of which has its own privacy policy governing their collection and use of your data:

  • RealScout

    Provides home search, home valuation, market alerts, and listing display services. RealScout collects and processes property search criteria, home addresses, and contact information to deliver these services. When you create a RealScout account, you are also subject to RealScout's Terms of Service and Privacy Policy.

    Used on contact forms and the Entrepreneur Discovery Questionnaire to verify that form submissions are made by humans, not automated systems. Google collects behavioral and device data to make this determination. This service is subject to Google's Privacy Policy and Terms of Service.

  • Google Forms

    Used to collect Entrepreneur Discovery Questionnaire responses. Submissions are processed and stored by Google and delivered to the EREG Broker. Google Forms is subject to Google's Privacy Policy and Workspace Terms of Service. The Discovery Questionnaire form was created inside Experience Real Estate Group, LLC.

  • WordPress (WP Engine)

    Our Site is built on WordPress and hosted on WP Engine's managed hosting platform. Standard WordPress cookies and WP Engine server logs may collect IP addresses, browser information, and session data for security and performance purposes. For logged-in EREG team members only, WordPress may also load profile avatar images from Gravatar, a service of Automattic Inc.; Gravatar is not used for ordinary site visitors.

  • Google Fonts

    We use Google Fonts to display typography on our Site. Google Fonts may log requests made to the Google Fonts API, including IP addresses. These requests are subject to Google's Privacy Policy.

  • Google Tag Manager

    We use Google Tag Manager (GTM) to manage and deploy tracking and analytics tags on our Site. GTM itself does not collect personal information; however, it loads and triggers other tools — including Google Analytics 4 — that may collect usage data as described below. GTM operates under Google's Privacy Policy and Terms of Service. All tags deployed through GTM are configured and controlled by EREG.

  • Google Analytics 4 (GA4)

    We use Google Analytics 4, deployed through Google Tag Manager, to collect anonymous information about how visitors use our Site. This includes pages visited, time spent on pages, general geographic region (country/state level), device type, and traffic source. Google Analytics uses cookies to distinguish unique visitors and sessions. We have enabled IP anonymization — your full IP address is never stored by Google Analytics. We do not use Google Analytics for advertising, remarketing, or cross-site tracking. Google Analytics event data is retained for 14 months, the maximum Google permits on our service tier; the analytics cookies themselves may persist for up to 24 months as described in Section 7. You may opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on. This service is subject to Google's Privacy Policy and Terms of Service.

When personal information is no longer needed, we take reasonable steps to ensure it is securely deleted or anonymized.

Data Security

We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, loss, alteration, or disclosure. These measures include:

  • SSL/TLS encryption for all data transmitted between your browser and our Site (HTTPS enforced site-wide)
  • Managed WordPress hosting on WP Engine with daily backups, firewall protection, and security monitoring
  • Role-based access controls — Entrepreneurs can only access their own client data, not the full site database
  • Two-factor authentication required for all administrative accounts
  • Google reCAPTCHA on all contact and form submission points to prevent automated abuse
  • Regular security updates applied to WordPress core and all plugins
  • No storage of sensitive financial data on our servers

No method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.

Data breach notification: In the event of a data breach that may compromise your personal information, we will notify affected individuals as required by Florida's Information Protection Act (Section 501.171, Florida Statutes) and any other applicable law.

Your Privacy Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Right to know — you may request confirmation of whether we hold personal information about you and receive a copy of that information.
  • Right to correct — you may request correction of inaccurate or incomplete personal information we hold about you.
  • Right to delete — you may request deletion of your personal information, subject to certain exceptions (such as data we are legally required to retain).
  • Right to restrict processing — in certain circumstances, you may request that we limit how we use your personal information.
  • Right to data portability — you may request a machine-readable copy of the personal information you have provided to us.
  • Right to opt out of sale or sharing — we do not sell or share your personal information for targeted advertising. No opt-out action is required.
  • Right to non-discrimination — we will not discriminate against you for exercising any of your privacy rights.

To exercise any of these rights, please contact us using the information in Section 15. We will respond to verifiable requests within 30 days. We may need to verify your identity before fulfilling a request.

For data held within RealScout, please also contact RealScout directly through your account settings, as they are an independent data controller for the information you provide through their platform.

Florida Privacy Rights

The Florida Digital Bill of Rights (Chapter 501, Part II, Florida Statutes), effective July 1, 2024, provides certain rights to Florida residents regarding their personal data. If you are a Florida resident, you have the right to:

  • Confirm whether a controller is processing your personal data and access that data
  • Correct inaccuracies in your personal data
  • Delete personal data you have provided or that has been obtained about you
  • Obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format
  • Opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects
  • Opt out of the collection or processing of sensitive personal data (as defined under Florida law)

Please note: The Florida Digital Bill of Rights applies to controllers that process the personal data of 100,000 or more Florida consumers per year, or that derive revenue from the sale of personal data. EREG does not sell personal data and may not meet the statutory threshold. However, we are committed to honoring these rights regardless of applicability thresholds.

To submit a Florida privacy rights request, please contact us at the address or email in Section 15. We will respond within 45 days and may extend by an additional 45 days where reasonably necessary with advance notice.

Children's Privacy

Our Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided personal information to us, please contact us immediately at the address in Section 15.

If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take prompt steps to delete that information.

Our Site is intended for adults who are at least 18 years of age and who are either current or prospective real estate clients, licensed real estate professionals, or persons with a legitimate interest in Southwest Florida real estate.

Do Not Track

Some browsers include a "Do Not Track" (DNT) feature that signals to websites that you do not want your online activities tracked. Because there is no universal standard for how websites should respond to DNT signals, our Site does not currently alter its data collection practices in response to DNT signals.

We support the Global Privacy Control (GPC) signal. If your browser or browser extension sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information — and because we do not sell or share personal information for advertising purposes, that request is honored automatically. In addition, when our Site detects a GPC signal from a visitor who has not yet made a cookie choice, we automatically apply the "Decline" setting for analytics cookies, so no analytics tracking occurs unless you later opt in through the "Cookie Settings" link in our footer.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice such as a banner on our Site homepage.

We encourage you to review this policy periodically. Your continued use of the Site after any changes constitutes your acceptance of the updated policy. If you do not agree to the updated policy, please discontinue use of the Site.
